The US Strengthens its Controls on AI Chip Exports Around the Globe

The U.S. announced new measures to further limit the export of artificial intelligence (AI) chips and related technology. These measures aim to consolidate advanced computing capabilities within the U.S. and its allies while blocking access for countries like China.

Under the updated regulations, the export of AI chips will be capped for most nations, while U.S. allies will continue to have unrestricted access. Exports to countries such as North Korea, China, Iran, and Russia will remain strictly prohibited.

The new rules, introduced as Biden’s administration nears its exit, extend beyond targeting China. They are designed to preserve the U.S.’s leadership in AI by tightening global control over the development and distribution of the technology. The rules represent a culmination of a four-year effort by the Biden administration to limit China’s ability to acquire advanced chips that could enhance its military power.

The incoming administration of President-elect Donald Trump is expected to evaluate and enforce the rules, which are set to go into effect 120 days after their publication.

The restrictions will heavily impact advanced graphics processing units, which are critical for training AI models in data centers. Leading producers of these chips include Advanced Micro Devices (AMD) and Nvidia, both of whose shares fell 5% and 1%, respectively, after the announcement.

Large cloud providers, such as Amazon, Microsoft, and Google’s parent company Alphabet Inc. (NASDAQ: GOOGL) (NASDAQ: GOOG), will be able to apply for international authorization to establish data centers. Once authorized, the providers won’t require separate export permits for AI chips, allowing them to establish data centers in nations where the United States has placed restrictions on chip imports.

To secure authorization, companies must adhere to strict rules, such as meeting security and reporting requirements and demonstrating a commitment to upholding human rights.

The regulations have sparked criticism from industry leaders. Nvidia described the measures as overreach while Oracle argued that they could strengthen China in the GPU and AI market.

The updated rules categorize nations into three categories. Tier 1 countries, including Japan, the U.K., the Netherlands, and South Korea, are largely exempt. Tier 2 nations, such as Saudi Arabia, Singapore, and Israel face export caps, while Tier 3 nations, including China and Russia, are completely barred from receiving AI technology.

Additionally, U.S.-based cloud providers granted global authorizations must limit their AI computing deployment outside the U.S., adhering to caps of 50% globally, 25% beyond Tier 1 nations, and 7% in any single non-Tier 1 nation.

In response to the regulations, China’s Ministry of Commerce stated that the country would protect its legitimate interests and rights against the new limitations.
