California Defies Trump, Institutes Its Own Rules on AI

California is moving to tighten oversight of AI firms that want to secure state contracts, setting up a direct clash with calls from President Donald Trump to keep the fast-growing sector largely unregulated. 

Governor Gavin Newsom recently signed an executive order that gives state officials four months to draft new rules focused on protecting the public from potential harms linked to AI systems. 

Firms must demonstrate safeguards to prevent their technology from generating or spreading illegal content, including child exploitation material and explicit violent imagery. They are also required to explain how their systems are designed to limit bias and avoid outcomes that could lead to unlawful profiling, surveillance, or discriminatory treatment. 

The order goes further by instructing agencies to establish guidelines for watermarking digital content created or altered by AI. 

In a written statement, Newsom emphasized California’s long-standing role as a hub for technological progress while acknowledging the risks that come with rapid innovation. He said the state intends to ensure that new technologies serve the public interest rather than expose people to harm. 

California’s action reflects a broader trend among states stepping in to regulate AI as concerns grow over its societal impact. Critics have warned that unchecked development could undermine job security, weaken labor markets, and introduce new forms of digital risk. States across the country have already enacted over 100 measures aimed at protecting minors from chatbot interactions and preventing the misuse of copyrighted material by AI developers. 

The move also highlights an emerging divide between state and federal approaches. The Trump administration has pushed for a unified national strategy that would reduce what it describes as a fragmented system of local regulations. Earlier this month, federal officials released a policy framework encouraging Congress to set nationwide standards while limiting state-level intervention. 

The framework argues that American companies need flexibility to compete globally and warns that excessive rules at the state level could slow innovation. It also calls for the creation of a legal task force within the Department of Justice to challenge state regulations seen as obstacles to industry growth. 

By contrast, California’s new directive leaves room for the state to establish its own procurement rules, even if they differ from federal guidance. The approach positions California as a leading voice among states seeking stronger oversight of artificial intelligence at a time when the balance between innovation and regulation remains a central national debate.
