Biden’s New Executive Order Allows AI Data Center Construction on Federal Land

President Joe Biden has signed an executive order to establish artificial intelligence (AI) data centers on six federal property sites. The centers are expected to prioritize clean energy and adhere to strict labor laws. Biden stressed in a statement that although the US is currently at the forefront of AI technology, it will take constant work to stay at the top.

The order directs the Departments of Defense and Energy to each identify three locations where private firms can lease. The companies will be responsible for funding, constructing, and operating the centers while ensuring they are fully powered by renewable energy sources. Additionally, developers must purchase a significant portion of U.S.-produced semiconductors to strengthen the domestic supply chain.

To accelerate the process, the federal government has committed to streamlining permits for constructing these facilities. Senior officials highlighted the importance of building robust AI infrastructure within the country for national security purposes. They pointed out that a strong domestic AI industry not only safeguards U.S. capabilities but also prevents adversaries like China from accessing similar advancements.

The executive order coincides with a recent announcement of new restrictions on exporting advanced AI chips and the proprietary parameters that govern AI systems. The measures, currently under a 120-day public comment period, aim to safeguard national security whilst providing clarity on how U.S. trusted partner nations can access emerging technologies to foster innovation.

Under the new rules, there will be no restrictions on AI chip exports to nations such as Canada, Australia, Japan, Germany, South Korea, and other allied countries. The restrictions build on earlier measures introduced in 2023, which limited the sale of specific AI chips to Russia and China, major competitors in advanced semiconductor manufacturing.

China has criticized the restrictions, with its Ministry of Commerce labeling them a violation of international trade norms. Beijing has vowed to take necessary steps to protect its interests and rights, calling the U.S. actions an abuse of export controls under the guise of national security.

For nations covered by United States arms embargoes, additional limitations will apply to the transfer of advanced AI systems with “closed weight” models, which keep operational parameters confidential. However, nations outside the embargo list will have no restrictions on licensing standards for getting advanced AI chips or equivalent systems currently in production.

U.S. companies and allies will have access to the most advanced closed-weight AI models, provided they meet stringent security standards, according to administration officials. It remains to be seen how entities like Palantir Technologies Inc. (NYSE: PLTR) will leverage the supportive U.S. environment to get ahead of their competitors abroad.
